WEBGENIC.COM is a web based e-book server (herein referred to as "WEBGENIC" or "the Server" or “WEBGENIC Server”). WEBGENIC.COM is owned, developed and offered by Webgenic Technology Solutions (herein referred to as "Webgenic" or "the company") whose primary business address is mentioned at the end of this document.

This User Agreement describes the terms and conditions applicable between Webgenic and the user (herein referred to as "the user") who avails WEBGENIC.COM ebook services.

You must read, agree with and accept all of the terms and conditions contained in this document before becoming a user of the service. If you do not agree to these terms and conditions you may not use the WEBGENIC.COM service. If you do not agree to these terms and conditions, do not click "I Agree" or "I Accept" buttons when asked by the WEBGENIC website during login or other times. Do not complete the registration process and do not use the WEBGENIC.COM service.

Description of Services

• WEBGENIC.COM (website : www.webgenic.com can be used to create E-Books in any of the following ways:

  • By uploading files stored on your computer.

  • Setting up user's website to automatically display E-Book in the visitor's browser when the visitor clicks on a link (pointing to a document such as PDF etc) in a webpage.

WEBGENIC.COM provides free and paid services to it users.

User Registration

WEBGENIC.COM users (herein referred to as "the user" or "you") can signup for the services at www.webgenic.com by providing First Name, Last Name, Country of Residence and email address.

Accepting the Terms

By signing up, the User has registered himself / herself for using the services of WEBGENIC. The User will be subject to following terms and conditions while availing the Services of WEBGENIC. The User will be notified, at the email address registered with us, of any changes to the Terms and Conditions.It would be the User’s responsibility, to peruse notified changes. These terms and conditions would be binding on the User at all times till the he / she continues to be an authorized / registered user of the services provided by WEBGENIC. By signing, the User agrees to the terms and conditions stated below until he / she opts out of being a registered user of WEBGENIC.

General Terms

The User confirms being a lawful resident of the country mentioned during signup (registration) and being a major as construed by existing law of the residing country.

These terms and conditions stated below may be changed, modified, altered, deleted by the Company as felt necessary from time to time without any specific intimation to the User. It would be the responsibility of the User to stay updated about the Terms and Conditions from time to time by visiting the official website of the Company in order to remain compliant with the conditions mentioned herein.

The User agrees to the Terms and Conditions stated herein by signing up as a registered user of WEBGENIC.

The Company shall have the right to change, modify, alter, cancel, suspend or discontinue any of the services of WEBGENIC without prior intimation to the User.

The User can discontinue using the Services at any time without prior intimation to the Company.

The Company shall have the right to close the account of the User without providing any reasons for the closure.

The User may print and or save these Terms and Conditions for his records.

Use of the Services by the user

As part of the signup process, the User will be required to provide some personal information. It will be the responsibility of the User to provide the complete and up to date information to the Company and the Company would totally rely on it without any independent verification and authentication process on it’s part. All or part of this information would be used by the Company to determine the identity of the User while providing certain services requested by the User. E.g. Request for new login id, request for new password etc. The Company reserves the right to deny any service or even terminate the account of the User, if, at any point of time, it is determined that the information provided to the Company is false or misleading.

Unless otherwise expressly agreed between the Company and the User, the User would use the Services in the format provided by the Company.

All the Services would be governed by the prevalent laws, rules and regulations as mandated by the Government of India and any amendments made to the laws from time to time. Any disputes arising would be subject to the jurisdiction of India.

The User hereby agrees to use the Service for legal purposes only. The User also agrees to not do anything knowingly or unknowingly that may lead to disruption of provision of Services or of the Servers and network of WEBGENIC.

The User shall not copy, duplicate, sell / resell any of the Services of the Company without obtaining specific permission for the same from the Company.

Damages to the User, the Company or any third party arising out of non compliance or breach of any of the Terms and Conditions would be the sole responsibility of the User and the Company or the Service would not be the responsible in any way or form.

The Company strongly disapproves of SPAM activities and does not take any responsibility for SPAM messages sent out by the User.

It would be deemed that information sent, circulated by the User to any person / persons is meant / intended for these person / persons. The Company does not take any ownership for verification of the circulation list of the User nor can the Company be held responsible in any way for the information sent, circulated.

The Company may screen the content for offensive, derogatory, indecent content and may take necessary action to filter such content. However, the Company cannot be held responsible for the content found offensive, derogatory, indecent by the recipient.

The User will be completely responsible for the content passed on using the Services and the Company will not be liable in any way or form for the actions of the User, to either the User or to any third party.

The User agrees to not make use of any automated system like 'robots', 'spiders' etc. to collect any sort of information like personal information, site usage and activities.

Prohibited conduct

The user agrees to not commit any of the following acts that are prohibited :

• use of ebook services in a way other than that intended by the Company

• make unsolicited offers, advertisements, proposals, or send spam or junk mail

• use the ebook services in violation of any local, state, national or international laws, including but not limited to laws regarding proprietary rights, copyrights, data protection and privacy

• defame, abuse, threaten or cause harm in any manner to any other users or upload any content that is objectionable, offensive, threatening, abusive, explicit or in any manner inappropriate

• impersonate any user, individual or company, access other user's account without permission, or commit any fraudulent act

• harm, disable, hack, damage or otherwise intervene with security related features of the service

• reverse engineer, disassemble, or make any other attempt to find the source code of the services provided herein

Your passwords and account security

Login information like username, password is confidential and the User agrees to maintain the confidentiality and not share this information with anyone. Sharing this information might lead to unauthorized access and use of the User account. The Company would in no way be liable for such unauthorized access and usage.

It would be the responsibility of the User to immediately notify the Company of actual or suspected unauthorized usage of his / her account. The Company would not be responsible for any unauthorized access or usage of the User’s account.

Any request or information coming from the email id registered with the Company would be considered as authentic and would be catered to. The Company would not be responsible in any way if the request from such email id is made by an unauthorized person.

Fees and Commercials

The company provides free and paid services to its users. The information about the pricing of paid services can be obtained by contacting the Company at the addresses given at the end of this document.

All users are expected to make agreed payment on time to ensure uninterrupted access to the paid Services.

All the billing information provided by the user for availing the services will be accurate.

The user will be liable to pay all applicable taxes or charges imposed by the government entities for availing the services.

Users access to the paid services will be suspended on non-payment of the agreed fees. The user must contact the company to restart the services.

Unless specifically granted by the company, the user is not permitted to resell the company's service to anyone.

The company reserves the right to change pricing of it's services based on the market conditions. Such changes may be conveyed to the users by posting on the company's website or by email.

Cancellation

You can cancel your access to the paid services by informing the company at the company's contact information. You will not be charged for the paid Service after cancellation.

Refunds

For any disputed charges, the company must be notified in writing or email within 30 days of any such cases. The refund will be made upon investigation and will be at the sole discretion of the company.

Copyright and trade mark policies

It would be deemed that the User has the intellectual property rights to the content or permission to use the content which is used in creating e-books on WEBGENIC. The Company would not be liable in any way or form for violation of the concerned laws by the User of the WEBGENIC e-book services.

The company may display or distribute content from 3rd party, organizations or individuals with whom the company has business relationship.

The user may not reproduce, modify or publish any such content in any form in any media unless the user has been specifically granted permission in writing from the Company.

Content license from user

The user retains copyright and any other rights the user already holds in content which is published on the WEBGENIC ebook server.

By using services of WEBGENIC, the user grants the company a non-exclusive, worldwide, royalty-free license to reproduce, modify and publish the content to any media. This license is for the limited purpose of promotional activities for the company's services only.

The user agrees that this license includes a right for the company to make such content available to other organizations or individuals with whom the company has business relationships.

Privacy Policy

The company collects information such as first name, last name, email address and country of residence when signing up for the WEBGENIC e-book services. The email address may be used to notify members about new or changed services at the company. The email address is also used to notify the member of the new or recovered password in cases where the member forgets his/her account password.

The company may update/modify it's privacy policy from time to time without notice to the user. It would be the responsibility of the User to stay updated about the changes from time to time by visiting the official website of the Company

Software updates

The company would continue to work on improving services, fixing problems, adding new innovative features and adding compatibility to upcoming technologies. This would require the company to upgrade WEBGENIC server software from time to time. The upgrade would be performed by the Company as felt necessary from time to time without any specific intimation to the User. The company would try its best to keep the server downtime to the minimum and least disrupting to its users. The Company shall not, in any way or form, be liable for any damages, direct, indirect, exemplary, which may be incurred by the User for the unavailability of the service during server downtime for software upgrade, repair or any such technical reasons.

EXCLUSION OF WARRANTIES

THE SERVICES AVAILABLE FROM THE COMPANY ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTY THAT IT’S SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY SECURE OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR THE SERVER THAT MAKES THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE COMPANY DOES NOT MAKE ANY WARRANTIES OR REPRESENTATIONS REGARDING THE USE OF MATERIALS OR CONTENT IN THE SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, USEFULNESS, TIMELINESS, RELIABILITY OR OTHERWISE. IF THE USER DISAGREES WITH ANY OF THESE TERMS OF USE, HIS / HER ONLY REMEDY WOULD BE TO DISCONTINUE USAGE OF THE SERVICES PROVIDED BY THE COMPANY.

LIMITATION OF LIABILITY

THE COMPANY SHALL NOT, IN ANY WAY OR FORM, BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, EXEMPLARY, WHICH MAY BE INCURRED BY THE USER, UNDER ANY THEORY OF LIABILITY.

Indemnity

The user will be solely responsible for the content/material submitted (posted, added, uploaded) to WEBGENIC. The user agrees to indemnify and hold harmless the company from any claim, action, demand, loss, expense or damages (including attorney fees) made or incurred by any third party arising out of or relating to user's conduct, user's violation of the Terms, or user's violation of any rights of a third party including negligent or wrongful conduct by the user or any other person accessing WEBGENIC services using the user's account.

Termination

This agreement is effective until terminated by either party. The user may terminate this agreement at any time, by deleting content belonging to the user account. The company may terminate this agreement at any time and without notice to the user, if, in its sole judgment, if the user is found to breach any term or condition of this agreement. Upon termination, all user content me be deleted without any notice to the user. The company is entitled to terminate all or any part of any of its service without any notice to the user.

Changes to the Terms

These terms and conditions stated in this document may be changed, modified, altered, deleted by the Company as felt necessary from time to time. When they are changed, the user will be automatically prompted to read and accept the revised Terms and Condition at the time of logging into the account. Users are also requested to stay updated about the Terms and Conditions from time to time by visiting the official website of the Company in order to remain compliant with the conditions mentioned herein.
